1. Membership Enrollment

• Membership is valid only upon completion of this Agreement, required waivers, and payment

• Membership is non-transferable

• Member must be at least 18 years old or have a parent/guardian sign if under 18

  
  
  2. Probationary Period (First 30 Days)

• All new members are subject to a thirty (30) day probationary period beginning on the start date of membership

• During this period, Sportrex Fitness reserves the right to observe member behavior, gym etiquette, and training routines to ensure alignment with facility standards and culture

• The probationary period is intended to ensure a safe, respectful, and compatible gym environment for all members

• Sportrex Fitness may, at its sole discretion, terminate or decline continuation of membership during the probationary period for reasons including but not limited to: Unsafe or reckless training behaviour

•  Disruptive, disrespectful, or inappropriate conduct

•  Repeated failure to follow gym rules or staff instructions

   • Termination during the probationary period does not obligate Sportrex Fitness to provide a refund, except          where required by law

 

    3. Membership Types & Access

   • Membership types and pricing are determined by Sportrex Fitness and may change with notice

• Basic Membership provides full gym access when paired with personal training services

• Membership access is subject to gym hours and facility rules 3. Personal Training & Coaching Services

• Personal training and coaching services are separate from membership fees

• All personal training clients must maintain an active Sportrex Fitness membership

  for tracking and liability purposes

• Training sessions must be booked through approved Sportrex systems

• Sportrex Fitness is not responsible for agreements made directly between members

  and independent trainers

  
  4. Rules, Conduct & Facility Use

• The Member agrees to:

• Follow all gym rules, policies, and posted signage

• Use equipment properly and return it after use

• Treat staff and other members with respect

• Refrain from aggressive, unsafe, or inappropriate behavior

  Sportrex Fitness reserves the right to revoke access for rule violations.

  
  5. Health & Medical Disclaimer

• Member affirms they are physically able to participate in exercise activities

• Member understands that exercise involves inherent risks

• Member is responsible for consulting a physician before beginning any fitness

  program

  
  6. Assumption of Risk & Waiver of Liability

• The Member voluntarily assumes all risks associated with participation in activities at Sportrex Fitness, including injury or illness.

•  The Member agrees to release, waive, and hold harmless Sportrex Fitness, its owners, staff, contractors, and affiliates from any claims arising from use of the facility.

 

        7. Membership Fees & Payments

• Membership fees are due as agreed at sign-up

• Failure to pay may result in suspension or cancellation of membership

• Membership fees are non-refundable unless required by law

  
  8. Freezes, Cancellations & Termination

• Freeze or cancellation policies are determined by Sportrex Fitness

• Sportrex Fitness reserves the right to terminate membership for misconduct, non-

  payment, or policy violations

• No refunds will be issued for terminated memberships due to violations

  
  9. Photo, Video & Media Release

• Member grants Sportrex Fitness permission to use photos or videos taken within the facility for promotional and marketing purposes unless otherwise stated in writing.

  
  10. Privacy & Confidentiality

• Member information will be kept confidential and used only for business and legal purposes

• Sportrex Fitness complies with applicable privacy laws

  
  11. Governing Law

• This Agreement shall be governed by the laws of Ontario, Canada.
